These Terms of Service ("Terms") govern your use of the Overlander platform operated by WestHash ("we", "us"). By creating an account or using our services, you agree to be bound by these Terms.

Description of Service

Overlander is a platform that connects nomads (van life travelers) with landowners who offer parking areas. The platform provides: interactive maps to discover parking areas; a geofence-based check-in/out system; a credit-based payment system for parking stays; in-app communication between nomads and landowners; area management tools for landowners.

Account Requirements

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must provide accurate and complete information during registration. You may select one role: "Nomad" (traveler) or "Landowner" (area provider).

Credit System

  • Credits can be purchased through the platform via secure payment processing.
  • Credits are deducted upon check-in and through daily billing cycles (every 24 hours) for ongoing stays.
  • Credits are non-refundable once purchased, except as required by applicable consumer protection laws (14-day withdrawal right for unused credits under the EU Consumer Rights Directive).
  • Landowners earn the credits spent by guests at their areas.
  • If your credit balance reaches zero or becomes negative during an active stay, automatic check-out will be triggered.

User Obligations

  • All users must: provide truthful information; use the platform in compliance with applicable laws; not attempt to manipulate the credit system; not harass other users through in-app communication.
  • Nomads must: enable geolocation services for check-in/out functionality; maintain sufficient credit balance for active stays; respect the rules and property of landowners.
  • Landowners must: provide accurate area descriptions and pricing; maintain areas in the condition described; respond to guest communications in a timely manner; ensure their areas comply with local regulations.

Check-in, Check-out, and Geolocation

The platform uses geolocation to verify your presence within designated parking areas. Area boundaries are defined by landowners and validated by our systems. Automatic check-in may occur after 15 minutes within an area boundary. Automatic check-out is triggered when leaving the area or when credits are exhausted. You consent to geolocation monitoring while using check-in/out features.

Intellectual Property

The Overlander platform, including its design, code, and branding, is the property of WestHash. User-generated content (area descriptions, photos, reviews) remains the property of the respective users, who grant us a non-exclusive license to display it on the platform. You may not copy, modify, or distribute any part of the platform without written permission.

Limitation of Liability

WestHash provides the platform "as is" without warranties of any kind, except as required by mandatory consumer protection laws. We are not liable for: the condition or safety of parking areas; disputes between nomads and landowners; loss of data due to circumstances beyond our control; service interruptions for maintenance or technical issues. Our total liability is limited to the amount of credits purchased in the 12 months preceding the claim. Nothing in these Terms limits our liability for fraud, gross negligence, or death/personal injury caused by our negligence.

Termination

You may delete your account at any time through the settings page. We may suspend or terminate accounts that violate these Terms, with prior notice except in cases of serious violations. Upon termination, unused credits remain available for 30 days for withdrawal (subject to applicable conditions).

Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. For users in the European Union, mandatory consumer protection laws of your country of residence apply in addition. EU consumers may bring proceedings in their country of residence. You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Online Dispute Resolution

Pursuant to Regulation (EU) 524/2013, the European Commission provides an Online Dispute Resolution (ODR) platform for consumers in the EU. You can access the ODR platform at https://ec.europa.eu/consumers/odr. For disputes related to our services, you may also contact us directly at overlander@westhash.io before initiating any formal dispute resolution procedure.

Changes to These Terms

We may modify these Terms with 30 days advance notice. Continued use of the platform after the notice period constitutes acceptance. Material changes will be communicated via email.
